By accessing or using Gateway Integrations' payment processing services and communication systems ("Services"), including SMS and voice communications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
SMS and Voice Communication Terms
This section governs your use of our SMS and voice communication services. By opting into our SMS or voice communications, you agree to these specific terms in addition to our general Terms of Service.
Consent and Opt-In
- By providing your mobile phone number and checking the consent box, you expressly consent to receive SMS messages and voice calls from Gateway Integrations
- You confirm that you are at least 18 years old and authorized to agree to these Terms
- You confirm that the mobile phone number you provide is your own or you are authorized to use it
- Your consent is not a condition of any purchase or service
- You may opt-out at any time without penalty
Types of Communications
You may receive the following types of SMS messages and voice calls:
- Payment processing alerts and transaction notifications
- Account security alerts and fraud prevention messages
- Service updates and system maintenance notifications
- Customer service and technical support communications
- Promotional offers and marketing messages (with separate consent)
- Survey and feedback requests
- Emergency or urgent security notifications
Message Frequency and Timing
Message and data rates may apply. Check with your mobile carrier for details about your messaging and calling plan.
- Frequency: Message frequency varies but may include up to 4 messages per week
- Timing: Messages and calls may be sent between 8 AM and 8 PM in your local time zone, unless it's an emergency security alert
- Promotional Messages: Marketing messages will not exceed 2 per week
- Transactional Messages: Payment and security-related messages are not subject to frequency limits
- Voice Calls: May be made for account verification, customer service, or urgent security matters
Supported Carriers and Devices
- SMS and voice services are supported by major carriers including Verizon, AT&T, T-Mobile, and Sprint
- Regional and prepaid carriers are generally supported
- Some carriers may not be supported - compatibility is not guaranteed
- Service availability may vary by geographic location
- International roaming charges may apply when traveling
Opt-Out Procedures
You can stop receiving SMS messages at any time using these methods:
- Text "STOP": Reply "STOP" to any message you receive from us
- Text "UNSUBSCRIBE": Reply "UNSUBSCRIBE" to opt-out

After you opt-out, you will receive a confirmation message, and no further promotional messages will be sent unless you opt-in again. You may still receive transactional messages related to your account.

Costs and Charges
- There is no charge from Gateway Integrations for receiving SMS messages or voice calls

- You are responsible for any charges from your mobile carrier
- International messaging and roaming rates may apply if you travel outside the United States
- Voice calls may incur charges based on your carrier's voice plan
Service Limitations and Disclaimers
- Service availability depends on your mobile carrier and network coverage
- We are not responsible for delayed or undelivered messages due to carrier issues
- SMS and voice services may be temporarily unavailable due to maintenance or technical issues
- We reserve the right to modify or discontinue these communication services at any time
- Message delivery timing is not guaranteed
2. Description of Services
Gateway Integrations provides third-party payment processing services specifically designed for legal entities. Our services include:
- Credit card and ACH payment processing
- API integration services
- Transaction reporting and analytics
- Fraud prevention and security monitoring
- Customer support and technical assistance
- SMS and voice communication services for account notifications and customer service
3. Eligibility and Account Registration
3.1 Eligibility Requirements
To use our Services, you must:
- Be a legitimate legal entity or law firm
- Be authorized to enter into this agreement
- Provide accurate and complete information
- Comply with all applicable laws and regulations
- Maintain PCI compliance standards
- Be at least 18 years old to use SMS and voice communication services
- Be authorized to use any phone numbers provided for SMS/voice communications
3.2 Account Registration
You must provide accurate, current, and complete information during registration and update such information to maintain its accuracy. This includes keeping your contact information, including phone numbers for SMS/voice communications, current and accurate.
4. Acceptable Use Policy
Important: Our services are exclusively for legitimate legal business transactions. Prohibited uses will result in immediate account termination.
4.1 Permitted Uses
- Legal fees and retainer payments
- Court filing fees and administrative costs
- Settlement and escrow transactions
- Other legitimate legal services
4.2 Prohibited Uses
- Illegal activities or money laundering
- Processing payments for non-legal services without authorization
- Circumventing security measures
- Violating any applicable laws or regulations
- Fraudulent or deceptive practices
- Using SMS/voice services for spam, harassment, or illegal communications
- Providing false phone numbers or using others' phone numbers without permission
5. Fees and Payment Terms
5.1 Processing Fees
You agree to pay all applicable processing fees as outlined in your service agreement. Fees are subject to change with 30 days' notice.
5.2 Settlement and Reserves
We may establish reserve accounts or delay settlements to manage risk, comply with regulations, or investigate potential fraud.
5.3 Communication Service Fees
SMS and voice communication services are provided at no additional charge from Gateway Integrations. However, standard carrier charges may apply based on your mobile service plan.
6. Security and Compliance
6.1 Your Responsibilities
- Maintain secure systems and PCI compliance
- Protect login credentials and account access
- Report security breaches immediately
- Comply with all applicable data protection laws
- Keep your phone number and contact information updated
- Protect your mobile device from unauthorized access
6.2 Our Responsibilities
- Maintain PCI DSS Level 1 compliance
- Implement industry-standard security measures
- Monitor transactions for fraud and suspicious activity
- Provide secure API and integration services
- Secure SMS and voice communications with encryption
- Partner only with reputable telecommunications providers
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATEWAY INTEGRATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE. THIS INCLUDES DAMAGES ARISING FROM SMS OR VOICE COMMUNICATION DELAYS, FAILURES, OR CARRIER ISSUES.
8. Indemnification
You agree to indemnify and hold harmless Gateway Integrations from any claims, damages, or expenses arising from your use of our Services, including SMS and voice communication services, or violation of these Terms.
9. Data Protection and Privacy
Your privacy is important to us. Please review our Privacy Policy, which governs the collection, use, and disclosure of personal information, including information related to SMS and voice communications.
10. Intellectual Property
All intellectual property rights in our Services, including software, documentation, and trademarks, remain our exclusive property.
11. Termination
11.1 Termination by Either Party
Either party may terminate this agreement with 30 days' written notice. You may opt-out of SMS and voice communications at any time without terminating your entire account.
11.2 Immediate Termination
We may immediately terminate or suspend your account for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Risk management concerns
- Misuse of SMS or voice communication services
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12.2 Arbitration
Any disputes arising from these Terms, including disputes related to SMS and voice communication services, shall be resolved through binding arbitration in Sacramento, California, except for claims that may be brought in small claims court.
13. Force Majeure
Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, government actions, network outages, or telecommunications service disruptions.
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated with 30 days' notice via email, website posting, or SMS (if you have opted in). Continued use of our Services constitutes acceptance of modified Terms.
15. Entire Agreement
These Terms, together with your service agreement and Privacy Policy, constitute the entire agreement between you and Gateway Integrations.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
